These Terms and Conditions explain the rules for using DAZZL. DAZZL is operated by A4J Global, LLC, a California limited liability company. In these Terms, “DAZZL,” “we,” “us,” and “our” mean A4J Global, LLC. “Services” means the DAZZL mobile app, dazzl.app, and related features and content.
Please read these Terms with a parent or guardian if you are under the age of legal adulthood where you live. By creating an account, purchasing a subscription, or otherwise using the Services, you agree to these Terms and acknowledge the DAZZL Privacy Policy. If you do not agree, do not use the Services.
The short version
- DAZZL is an educational and self-development tool for students. It does not provide medical care, mental health treatment, or emergency services.
- You may use DAZZL only if you meet the minimum-age rules below.
- You keep ownership of the goals, tasks, notes, and other content you create. You give us only the limited permission needed to operate the Services for you.
- Paid subscriptions renew automatically unless canceled through the store or platform used to purchase them.
- Be respectful, lawful, and do not interfere with the app or misuse its content.
- Beta Services are unfinished and may change, stop working, or have test data reset. All beta conditions are included in Section 11 rather than a separate beta agreement.
The summary helps explain the Terms, but the full Terms below control.
1 Who may use DAZZL
You may use the Services only if you can legally agree to these Terms or a parent or legal guardian agrees for you where required.
- In the United States, you must be at least 13 to use the Services.
- In South Korea, you must be at least 14 to use the Services. DAZZL does not currently offer a parental-consent process for younger users.
- If the law where you live sets a higher minimum age for agreeing to online services or processing personal information, that higher age applies.
- If you are under the age of legal adulthood where you live, your parent or guardian should review these Terms with you and supervise your use as appropriate.
If we reasonably believe that an account was created in violation of these age rules, we may suspend or delete it and remove associated personal information as required by law.
2 What DAZZL provides
DAZZL offers tools intended to help students plan, focus, reflect, build performance skills, and practice healthy approaches to school, tests, sports, performances, and other challenges. Features may include task and goal planning, focus sessions, reminders, performance questionnaires, guided audio, mindset exercises, progress tools, and rewards.
Features may differ by device, region, account type, or app version. Some features need an internet connection, notifications, or an account. We may improve, add, remove, or change features over time.
3 DAZZL is not healthcare or emergency support
DAZZL provides general educational, performance, and self-development content. It is not a medical device and does not provide medical advice, diagnosis, psychotherapy, counseling, or treatment. DAZZL does not promise a particular academic, test, athletic, emotional, or performance result.
Do not use DAZZL as a substitute for a qualified teacher, counselor, psychologist, physician, or other professional. If you are worried about your health or safety, contact a trusted adult or qualified professional. If you or someone else may be in immediate danger, contact local emergency services.
4 Accounts and guest use
Some features may be available without an account. Other features may require an account so that information can be saved, synchronized, or restored.
When you create an account, you agree to provide accurate information, protect your login credentials, and tell us promptly if you believe someone has accessed your account without permission. You are responsible for activity on your account unless applicable law provides otherwise.
If you sign in through Kakao, Naver, Apple, Google, or another provider, that provider’s terms and privacy policy also apply to its service. We do not receive your third-party account password.
5 Your content
“Your Content” means goals, tasks, plans, reminder text, notes, questionnaire responses, selections, feedback, and other material you enter or submit through the Services.
You keep any rights you have in Your Content. You give DAZZL a limited, non-exclusive, worldwide license to host, store, copy, process, transmit, and display Your Content only as reasonably needed to provide, secure, support, and improve the Services for you. This license ends when Your Content is deleted from our systems, except for limited backup copies, legal retention, and de-identified information that can no longer reasonably identify you.
You are responsible for Your Content and must have the right to provide it. Do not enter information that is unlawful, harmful to another person, or that you do not have permission to use. Avoid entering highly sensitive information that DAZZL does not need.
If you send us product feedback or suggestions, you allow us to use them without payment or restriction, but we will not publicly identify you without permission.
6 DAZZL content and intellectual property
The Services, including the software, visual design, brand, exercises, questionnaires, audio, video, text, illustrations, characters, and other DAZZL content, are owned by DAZZL or its licensors and are protected by intellectual property laws.
We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial purposes while you follow these Terms. You may not copy, sell, publish, distribute, license, modify, create competing materials from, or commercially exploit DAZZL content unless the law permits it or we give written permission.
7 Acceptable use
You agree not to:
- use the Services unlawfully or violate another person’s rights;
- bully, harass, threaten, exploit, or impersonate another person;
- try to access another person’s account or non-public parts of the Services;
- upload malware or interfere with the security, availability, or normal operation of the Services;
- scrape, crawl, automate access to, or extract substantial parts of the Services without written permission;
- reverse engineer or bypass technical limits, except where applicable law expressly allows it;
- use DAZZL content or data to build, train, or improve a competing product or model without written permission; or
- use the Services for commercial resale or unauthorized advertising.
We may investigate suspected misuse and take proportionate action, including restricting or suspending access. Where reasonably possible, we will provide notice and an opportunity to respond.
8 Subscriptions, purchases, and refunds
DAZZL may offer free and paid features. The price, billing period, trial terms, and benefits shown when you purchase control that transaction.
If you buy through the Apple App Store or Google Play, the store processes your payment. Its payment, cancellation, and refund rules also apply. We do not receive your full payment card number.
Subscriptions automatically renew for the same period unless canceled before the renewal deadline shown by the applicable store. Your store account may be charged within 24 hours before the current period ends. You can manage or cancel a subscription through your Apple App Store or Google Play account settings. Deleting the DAZZL app or your DAZZL account does not automatically cancel a store subscription.
If a free trial is offered, its length and conversion date will be shown before you subscribe. Unless canceled before the trial ends, it may convert to a paid subscription. Refunds are provided according to the applicable store rules and mandatory consumer law. We will give any legally required notice before a price change applies to a renewal.
9 Notifications and device permissions
DAZZL may ask for permission to send reminders or notifications. You can change notification permissions in the app or your device settings. Some reminder features may not work if permission is denied or if your device is offline. Carrier or data charges may apply.
10 Third-party services and links
The Services may rely on third-party app stores, login providers, notification services, analytics providers, or links. Their services are governed by their own terms and privacy practices. We are not responsible for a third-party service that we do not control, but this does not limit any responsibility we cannot exclude under applicable law.
11 Beta and pre-release features
This section applies to DAZZL beta, preview, early-access, and experimental features (together, “Beta Services”). You do not need to enter into a separate beta-testing agreement to participate. Short notices shown during signup or invitation explain key parts of this section but do not create a separate agreement from these Terms.
Participation and eligibility. Participation is voluntary, and unless we expressly say otherwise, no payment or compensation is provided. Applying or receiving an invitation does not guarantee participation. We may invite users in phases based on grade, device type, technical compatibility, testing capacity, and the purpose of the test. A beta invitation is personal to the invited user and may not be transferred.
Pre-release nature. Beta Services are unfinished products. Features may be incomplete or inaccurate and may contain errors, delays, interruptions, compatibility problems, or unexpected behavior. Features, screens, content, rewards, regions, and technical requirements may change or be removed before or after public release. A feature offered in beta is not guaranteed to launch publicly.
Test data and backups. We may need to reset, migrate, modify, or delete beta accounts, progress, settings, virtual rewards, or other test data to operate the test, correct errors, address security issues, or make technical changes. Where reasonably practical, we will give notice before a significant reset. Do not keep the only copy of important information in a Beta Service, and separately back up anything you need to retain. This paragraph does not limit our obligations under the Privacy Policy or any responsibility that cannot legally be limited.
Feedback and diagnostics. We may request bug reports, descriptions of your experience, survey responses, and product-improvement suggestions. Providing feedback is optional. We may use feedback you provide without payment to develop and improve our products and Services as described in Section 5. The DAZZL Privacy Policy applies to personal information, usage information, and diagnostic information processed during beta use.
Protecting non-public features. If we clearly identify a particular beta feature, material, or communication as confidential or non-public, you may not publish or distribute it. This may include unreleased screens, recordings, test links, and feature descriptions. This restriction does not apply to information that is already public, information you lawfully knew without a confidentiality duty, information you developed independently, disclosures required by law, or reports and requests for help made to authorities or professionals concerning safety, unlawful conduct, or consumer rights. A minor may always discuss their beta experience with a parent, guardian, or legal representative.
Safe testing. You may not exploit bugs or security issues, access another user’s information, perform automated testing, security testing, or reverse engineering without permission, publish a non-public vulnerability, or interfere with the test environment. Please report security issues to hello@dazzl.app. We will not penalize users for reporting an issue in good faith.
Restriction and termination. We may limit, suspend, or end beta participation for reasonable reasons, including a change in testing purpose, capacity, device compatibility, security, legal requirements, or a violation of these Terms. Where reasonably practical, we will provide notice. You may stop using the Beta Services at any time.
Service assurances and responsibility. Given their pre-release nature, Beta Services are provided “as is” and “as available” to the extent permitted by applicable law. We do not promise that they will operate without interruption or errors or work with every device. This paragraph does not exclude or limit liability for our willful misconduct or gross negligence, legally required warranties, or any other right that cannot legally be limited.
12 Availability changes and updates
We work to keep DAZZL useful and available, but we do not guarantee uninterrupted or error-free operation. Maintenance, technical problems, device settings, internet outages, app-store decisions, or events beyond our reasonable control may interrupt the Services.
We may update the app or change, suspend, or discontinue a feature. Where required by law or reasonably practical for a significant reduction in the Services, we will provide advance notice.
13 Ending your use
You may stop using DAZZL at any time. You may request account and data deletion through the app, if available, or at https://dazzl.app/contact-us-en. Subscription cancellation is separate and must be completed through the store or platform used for purchase.
We may restrict or end access if you materially breach these Terms, create a security or legal risk, or repeatedly misuse the Services. We will use a proportionate response and provide notice where reasonably possible. Provisions that by their nature should continue will survive, including intellectual property, disclaimers, limits of liability, and dispute terms.
14 Privacy
Our Privacy Policy explains what information we process, why we use it, the providers that help us, and the choices available to students and parents. It is available at https://dazzl.app/policy-en.
15 Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available.” We do not make warranties that the Services will always be available, secure, error-free, or suitable for every user, or that using DAZZL will produce a particular result.
Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot legally be excluded.
16 Limits on liability
To the maximum extent permitted by law, DAZZL and its owners, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, opportunities, or goodwill, arising from the Services.
To the maximum extent permitted by law, our total liability for claims relating to the Services will not exceed the greater of US $100 or the amount you paid to DAZZL for the Services during the 12 months before the event giving rise to the claim.
These limits do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation.
17 Responsibility for violations
If your intentional unlawful conduct or material breach of these Terms causes a third-party claim against DAZZL, you agree, to the extent permitted by law, to be responsible for the resulting losses and reasonable costs. This section does not require a minor to assume responsibility that cannot legally be imposed and does not reduce any consumer protection.
18 Governing law and disputes
Please contact us first at hello@dazzl.app so we can try to resolve a concern informally.
Except to the extent mandatory local law provides otherwise, these Terms are governed by California law, without regard to conflict-of-law rules. Any court proceeding must be brought in the state or federal courts located in Orange County, California. Consumers may bring claims in another court or forum when mandatory law gives them that right.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19 Changes to these Terms
We may update these Terms to reflect changes in the Services, law, security, or business operations. We will post the updated Terms with a new effective date. Where required by law, we will notify you in advance and obtain consent. For material changes that disadvantage users in South Korea, we intend to provide at least 30 days’ advance notice unless a different period is required or an urgent legal or security change makes advance notice impracticable.
If you do not agree to an update, stop using the Services before it takes effect. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.
20 Apple App Store terms
If you download DAZZL from Apple’s App Store, you acknowledge that these Terms are between you and A4J Global, LLC, not Apple. Apple is not responsible for the Services or their content and has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as provided by its rules. To the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for claims relating to the app, including product liability, legal compliance, consumer protection, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you. You must also follow the App Store usage rules and applicable third-party terms.
21 Export and sanctions compliance
You may not use or export the Services in violation of applicable export-control or sanctions laws. You represent that you are not prohibited from receiving the Services under applicable law.
